RULES AND REGULATIONS, REVISION
2012
The purpose of these Rules and Regulations is to ensure a harmonious
relationship between tenants and neighbors residing in Gildersleeve Park for
Mobile Homes. The setting forth of
what is expected of a tenant by the landlord should eliminate any confusion or
friction between tenants, neighbors, and the landlord.
The close proximity of mobile home living necessitates a set of
guidelines which equally applied, protects everyone governed thereunder and
protects their investment as well.
The vast majority of mobile home owners prefer a reasonable set of rules and
regulations to adhere to and live by.
1.
Gildersleeve Park for Mobile
Homes shall be used by its tenants for residential purposes exclusively.
No business use is permitted.
No peddling, soliciting, nor circulation of petitions is permitted.
Pursuant to ยง 233 of the Real Property Law, no other use will be allowed
that is in violation of federal, state, and local laws which may be detrimental
to the safety and welfare of other persons residing in the mobile home park.

If the Lease or Rental Agreement is entered into by one tenant, same
shall be construed to permit occupancy by the tenant, immediate family of the
tenant, one additional occupant, and dependent children of the occupant,
provided that the tenant or the tenant's spouse occupies the premises as his or
her primary residence.

If the Lease or Rental Agreement is entered into by two or more tenants,
same shall be construed to permit occupancy by tenants, immediate family of
tenants, occupants and dependent children of occupants; provided that the total
number of tenants and occupants, excluding occupants' dependent children, does
not exceed the number of tenants specified in the current Lease or Rental
Agreement, and that at least one tenant or a tenant's spouse occupies the
premises as his or her primary residence.

The tenant shall inform the Gildersleeve Management Co., Inc., of the
name of any occupant within thirty (30) days following the commencement of
occupancy by such person or within thirty (30) days following a request by the
landlord.
5.
No occupant or occupant's dependent child shall, without express written
permission of the landlord, acquire any right to continued occupancy in the
event that the tenant vacates the premises or acquires any other rights of
tenancy.
6.
All children shall be confined to their lot and will not be permitted to
play in the street or roam through any other tenant's lot.
7.
All monthly lot rentals shall be payable in advance on the first day of
each month. Any rent not paid by the
tenth (10th) day of each month shall incur a late charge equal to
five (5%) percent of the amount of unpaid rent as of the tenth (10th)
of the month. In the event legal
proceedings are instituted to collect unpaid rent, the landlord shall be
entitled to an award of legal fees as determined and fixed by a court of
competent jurisdiction and same are to be included in the judgment awarded.
8.
No mobile home should be sold to stay in the park without the written
approval of the landlord. Please
consult the landlord before concluding any sale.
The landlord will assist any tenant who desires to sell his mobile home.
Tenant will be responsible for all charges incurred in moving of the
mobile home, plus storage fees at the rate of Fifty ($50.00) Dollars per day.
Gildersleeve Management Co., Inc., will not be responsible for any
damages to mobile homes located anywhere on park property.
9.
If upon written notice any tenant who fails to comply with cleanliness or
other regulations, the management will have the work completed and will bill the
tenant accordingly.
10. The
tenant is responsible for the proper care and maintenance of his or her mobile
home and lot. The tenant shall
maintain their lot in a clean, neat, and attractive manner with grass, shrubs,
and non-park owned trees trimmed as often as necessary.
Tenants may not store bottles, cans, trunks, boxes, or equipment, etc. on
their lot outside of their storage shed.
Neighboring tenants will have access to walk around the side of their
home to wash the home and windows, and have access to the water supply and heat
tape. Therefore, plants and shrubs
should not be against your neighbor's home.
11. All
telephone numbers, both business and residential, should be registered with the
park office for emergency purposes.
12. Any
additions such as storage sheds, enclosed rooms, fences, decks, awnings, air
conditioners, or any other kind of additions must be approved by the landlord.
Air conditioners must be installed on your patio side of the mobile home
in order not to disturb your neighbor.
Any construction commenced prior to approval by the landlord shall result
in the removal at his or her expense.
No pools or hot tubs are permitted on Gildersleeve park grounds.
13.
Tenants with steel storage sheds are responsible for keeping them in good repair
and painted. Tenants may replace a
steel storage shed with aluminum or wood with siding after prior approval of the
landlord. The landlord reserves the
right to require removal and replacement of poorly maintained storage sheds.
14.
Tenants are prohibited from tampering with any meter, meter boxes, sewer
connection, electrical lines, or any other park equipment or property.
Any damage resulting from such tampering will be the tenant's
responsibility. Tenants are further
cautioned against driving pipes or stakes in the ground and against digging
without first checking with the landlord in order to avoid damaging underground
installations.
15.
Tenants shall take care not to clog toilets or sink lines with heavy or greasy
debris since such use can cause sewage problems.
Any obstruction between the mobile home and the cesspool/sewer line is
the tenant's responsibility. Any
leak that fills the cesspool will be the responsibility of the tenant to pump
his or her cesspool.
16.
Heat tapes should be plugged in before the first frost or no later than November
1st to prevent the exposed water lines from freezing.
The repair or replacement of frozen water lines or heat tapes will be the
tenant's responsibility.
17. No
wash is permitted to dry outdoors on Sundays and holidays.
Tree to tree or patio post to post, wash lines are prohibited.
Umbrella type wash lines are permitted.
18. No more
than one dog per mobile home. Dogs
must be walked on a leash outside the park grounds and away from other homes.
Dog waste must be cleaned up immediately, anywhere within the grounds,
including tenant's lot. As of
December 1, 2001, no dogs weighing in excess of 20 pounds will be permitted on
park grounds due to insurance regulations.
Any tenant's dog who is barking excessively will be deemed a nuisance and
be handled as such. Dogs are not to
be left outside of the home unattended.
Please have guests leave their pets at home.
19. Do
not throw bread or any other food on the ground to feed the birds or squirrels.
Bird feeders aboveground are permitted.
The feeding of dogs and cats on your patio is prohibited as it may bring
stray animals and rodents into the park.
20.
Unreasonable noises including, but not limited to, those generated by loud music
and television are prohibited between the hours of 11:00 p.m. and 8:00 a.m.
Violations of privacy, intoxication, and disorderly conduct are
prohibited and may result in police arrest and/or eviction if the rights of
other tenants are affected. The
consumption of alcoholic beverages is prohibited in park roadways and parking
areas. If a tenant fails to cure a
violation or persistently violates the rules after receipt of a ten (10) day
written notice from the landlord, then eviction proceedings may be initiated.
21. All
tenants, guests, and delivery vehicles must abide by the speed limit of 8 mph in
the park.
22.
Every tenant will be held responsible for any disturbance or damage caused to
any other tenant or their property due to their own conduct or the conduct of
their guests or pets.
23.
Commercial vehicles, except those making local deliveries, are not permitted in
the park. Pick-up trucks owned by
tenants and used as a personal vehicle are permitted.
24. All
vehicles must be registered with the park office including make, model, and
registration number. No unregistered
vehicles, trailers, boats, or personal watercraft may be stored on park grounds.
Owners of such vehicles will be notified to remove the vehicles or they
will be towed at the owner's expense.
25. All
tenants are prohibited from washing their cars by hose, changing oil, flushing
radiators, repairing, dismantling, or overhauling their vehicles on park
grounds. Only emergency repairs are
permitted, such as changing a flat tire or jumping the battery.
Tenants are responsible for any damage to roads due to a leak from their
vehicle.
26. Due
to limited parking spaces, tenants will be allowed a maximum of two (2) parking
spaces per mobile home, one car per person parked in pre-approved designated
spaces. Absolutely no parking of
cars between mobile homes is allowed except where driveways have been approved
by the landlord.
27. Due
to the limited parking spaces, visitors must park in designated visitor parking
spaces or outside the park grounds.
The parking of vehicles on main roads or restricted areas is strictly prohibited
due to fire code regulations.
Violators will be towed at their own expense.
28. Due
to sanitary conditions and current Board of Health regulations, garbage must be
in plastic bags and tied closed before placing in dumpsters.
Please attempt to throw garbage to the rear of the dumpsters.
29.
Shrubs, grass, leaves, tree branches, and newspapers should be put in bags or
tied into small bundles and placed in dumpsters Mondays through Thursdays, only.
Do not put these items in dumpsters on the weekends.
All building materials, furniture, mattresses, appliances, or any other
large items should not be put in or around dumpsters, please consult with the
landlord for a designated storage location.
30. The
landlord reserves the right of access to all lot locations for the purposes of
utility maintenance and inspection.
31. The
landlord will attempt to deal promptly and fairly with any complaints that are
submitted in writing and delivered to the park office during normal business
hours. However, all personal
grievances must be settled between the tenants.
32. The
landlord shall not be liable for any debts, liabilities, or damage claims for
personal injury, including tenants and their guests.
33.
Eviction proceedings will be instituted against a tenant for failure to pay rent
after thirty (30) days written notice to cure has been provided to the tenant.
34. A
resident will be given ten (10) days to correct a violation of these Rules and
Regulations after receiving written notice.
If he or she fails to correct said violation he or she will then be asked
to vacate the lot within thirty (30) days.
35. As
to the tenants who are not under a written lease, the landlord reserves the
right to revise these Rules and Regulations at any time upon giving a thirty
(30) day written notice to all tenants.
36.
Revision to Section No. 18 dated September 16, 2007.
No dogs weighing in excess of twenty (20) pounds including, but not
limited to, Rottweilers, Pit Bulls, and Doberman Pinchers will be permitted on
park grounds due to insurance regulations.
Revision to Section No. 18 dated September 28, 2012.
Dogs are not to be left outside of the home unattended.
37.
Revision to Section No. 12 dated September 28, 2012.
No pools or hot tubs are permitted on Gildersleeve park grounds.
All of the Rules and Regulations heretofore mentioned are provided for
the convenience and welfare of the park residents.
We realize that some of these rules may sometimes cause inconveniences,
but they are necessary for keeping Gildersleeve Park for Mobile Homes a clean
and well kept community.
